I had two resits, will they use my original marks or my resit marks, (both will be capped at 40), to calculate my first year mark overall?

Assuming you passed the re-sit then the capped 40% mark would usually end up on the transcript. If the re-sit is lower than the origional then thats not a pass and is likely to trigger another re-sit if thats allowed.
