Maintenance Loan less than 5 years

Hello,

I am a college student thinking about going to university after the completion of my course level 3 Extended Dimploma BTEC which will end on may 2020.

In order to be able to pay for my accomodation and living i.e. Food etc. I would need to make an application for the maintenance loan.

I have moved to the UK over 3 years ago from Poland, but I don’t have a settled status yet. I live with my GUARDIAN (Auntie) which has a permament residence in the UK.

The questions that I would like to ask you are;
1. Do I need to have a settled status in order to get a maintenance loan or 3 years of living in the UK is enough?
2. Is it possible to get a settled status thanks to my guardian which lives with me, works and has a permanent residence ?
3. Can I apply for maintenance loan same as UK nationals thanks to the settled status?

Additionally I was in employment for 2 years.

Hi there,

You do not need settled status, you need five years of residency in the UK or you need to be working to qualify as a Migrant Worker. You cannot claim finance based on your aunt. For settlement queries, please contact the Home Office.

Why does this website state that these are required ? It doesn't say anything about 5 years residence.
Students can apply if:

they’re a UK national or have ‘settled status’ (that means there’s no restrictions on how long they can stay in the UK)
they normally live in England
they’ve been living in the UK for at least 3 years before the first day of the first academic year of their course

- If you’re an EU, EEA or Swiss citizen, you and your family can apply to the EU Settlement Scheme to continue living in the UK after 30 June 2021. If your application is successful, you’ll get either settled or pre-settled status.

If you have settled status under the EU Settlement Scheme before the first day of the first academic year of your course you'll likely be eligible. If you gain pre-settle status this isn't taken into consideration.

If you don't qualify under these rules, you'll need to apply for an EU Tuition Fee Loan only.

So if i will have a settled status, 3 years of residence will I be eligible for maintenance loan?

I would also like to add that my auntie is my legal guardian and has a UK residence. Would I be eligible for a settled status?

To apply for a Maintenance Loan as an EU national, you need to have 5 years residency in the UK prior to the first day of the first academic year of your course, if you don't meet the 5 year residency criteria then the only other way to apply is by meeting the Migrant Worker criteria http://ow.ly/2x0230oL92f.

He’s literally an employee from SFE, you can’t get much more of a trusted source regarding SFE policies...

As an EU National applying to Student Finance England, you need to meet the criteria I mentioned in my previous post, there are no other exceptions. Either 5 year UK residency or applying as a Migrant Worker.
