I'd really appreciate the help as I'm very confused! I have an assignment to do about termination of a contract (which we were hardly taught because of the virus)

So its a problem question and a party wants to terminate the contract for a breach (the contract said that the other party would provide a service for a particular date but provided it a week later). Can the party terminate the contract on this basis?

I’ve researched the law behind it but not sure how to apply it because I dont know if the breach would be a condition, warranty or innominate term

So you havent done enough research about the law because if you had, you would have an answer. There are tons of cases about terms!

My replies are helping you to go and do your own research rather than relying on what others say.

So what exactly is the term that is in question?
If its a condition, can they terminate?
If its a warranty can they terminate?
If its an innomiate term, can they terminate?

Ah I understand better now, initially I thought that condition and warranty distinction is outdated and the new law is innominate terms in every case, thank you
