UKFPO Right to work

Eligibility outcomes were released today and those with an Irish or any other EU passport have been deemed eligible with conditions. Does anyone know anything about this ? I was thinking it could be a mistake as I thought the withdrawal agreement stated that Irish citizens could live and work freely in the UK ?

If it isn't a mistake - how to apply for right to work ?
in your application did you indicate that "Would you like to use the passport evidence as right to work proof? - Yes" or did you select the option “I wish to send in right to work as per the deadline in the eligibility applicant guidance”?

I did the same and I don't know what to do now. Does anyone know what documents are suitable to prove right to work and what is the deadline to provide them? Can I participate in the programme while 'Eligible with conditions' and prove my right to work right before I need to go to the hospital next year?

I filled it out the same way and emailed the help desk, after outcomes were posted, and was given general advice and a link to https://foundationprogramme.nhs.uk/resources/right-to-work/

I still don’t know if we need to appeal or if we can submit an application while having the condition in place.

I have no idea, it's not really clear to me. I'm not even sure when the deadline is ?

I was of the understanding that when you got a job they would sort out a tier 4, but I feel like the deadline date is before job allocation ?

Now I have come across so many people in the same position so I am surprised they haven't clarified they just keep sending that link and have posted on the website that they are not immigration specialists.

I also saw that applying for a visa requires another English test that isn't OET? but then if you can register with the GMC - you wouldn't need that. But how to register when people haven't graduated ? I can imagine the visa process takes a little while and there is only a short window between graduation and registration then to get a visa also. It just so confusing.

In all the 3 options for non-UK nationals to submit evidence, there was no consideration for the fact that those who applied to the EU resettlement scheme were not given paper based evidence of their status and it’s all online, you can use the share code of your online status if you have settled status/permanent leave to remain in the UK from your application if you did apply, however this is not listed as an option on the RTW section on their website.

There is an option to submit Home Office documentation of your right to work in the UK, however the EU resettlement scheme did not send out actual documents to those who applied but an email, which states that it’s not an indication of your settled status, and instructions on how to check your status and prove your right to work, which again is all online based. I hope this is making sense.


In conclusion, on the ORIEL portal there is no information on where/how to submit the evidence which they require, nor a deadline which also adds to the confusion, I have emailed them again to ask for clarity.

The thing is I can imagine that most people applying don't even have settled status as they are probably still studying in their home countries and cannot move before. So at least you have the evidence your problem is passing it to them in acceptable form. It's just so messed up and is quite stressful with everything else going on. I just hope they give some other info soon. I mean I wasn't even sure whether it should be appealed ?

I completely understand and they should make things way more clearer for everyone applying.
In fact, this is a huge drama unfolding for a lot of EU/EEA citizens... I study abroad in Italy, as I'm British, I obviously was considered eligible with RTW, but every single one of my colleagues (nationals of various EU/EEA states, including surprisingly one Irish guy), have been told they need to present extra evidence of RTW...

The thing is, the UKFPO has yet to answer any email sent by anyone of us, seeking for clarifications in regards to what the hell they actually want, and when by? Their official guidance simply points people towards the Home Office website, which itself states that EU/EEA citizens have RTW until 31st Dec and basically only God knows what will happen thereafter. All of my colleagues used their passports as evidence of RTW thinking it would be sufficient, but seemingly not. Except who on Earth knows what is? Do they expect a certificate of sponsorship for a tier 2 visa? (Which, for an EU/EEA citizen right now, is actually impossible to apply for because they are simply ineligible at this given moment).

About 20 applicants in my class alone are all sat here on tenterhooks, waiting for the UKFPO to get back to us.... we know that they've answered to other emails in the meantime, so we imagine that they themselves are just as clueless on this as we are, as no one knows what EU/EEA rights will be after the end the transition period.

If anyone has any advice, would be appreciated. So far, all my colleagues have had to send an email to expressly state they want to use their passport as proof of RTW, given who AT THE CURRENT MOMENT IN TIME, that is the only thing to be done.

did they get a positive reply to their emails? or were they told to appeal?

i received a general one stating:
"If you are an EU/EEA citizen and have provided an EU/EEA passport as your right to work evidence in your eligibility application, note that this is not valid evidence of right to work for commencing the UK Foundation Programme in August 2021. which doesnt explicitly say what the recommendations/options are

I'm glad to see there is quite a few of us facing this problem. If anyone, who used their passport as proof, finally receive an answer, please let everyone here know!
I got a reply - basically saying if you have the documentation to prove you have RTW then send it in by some date in Feb, but if you are looking for sponsorship you do nothing right now.

Can you post a screenshot? February is a long time, I guess we Europeans could get to UK until 2021 and get presettled there
I got an email saying: “Dear Applicant,

Thank you for your query regarding right to work. The UKFPO is currently seeking advice from the Home Office regarding right to work documents and we will update applicants via our website once we have received further guidance and clarification.”

UPDATE: So, following this, I began writing to the UKFPO quite vociferously (we had worked out that they were replying promptly to any query that was unrelated to this issue, so were seemingly selectively ignoring this issue). They replied to me and initially tried to just brush me away, but I persisted... I started saying that I would begin writing letters to my MP, government and national newspapers "all EU junior doctor applicants rejected during middle of a pandemic because of impossible to obtain RTW documents".... anyway, after that, they got back to me with a really nice email. The sort of one they should have been sending out to everyone in this situation in the first place. They replied to me yesterday, sorry I forgot to post it on here straight away! Though I see that they've started sending the same message to others now, too.

Anyway, here is a copy of their email:

Essentially, no EU/EEA applicant is about to be rejected for this (so there is no urgent deadline to find impossible RTW evidence). They are consulting with the UK Gov to find a solution. I imagine that everyone will just have to wait until the New Year, when they'll be able to get sponsored for a Tier 2 visa
