Transferring unis, will I be capped at 40%

I’m currently in my second year and have pretty much decided that I wanna move unis, I have applied and it looks like the only way it is possible is if I retake second year. I’m more than happy to do this, but I’ve heard that when you retake a year, your capped at 40%. Is this correct? Does the cap still apply when transferring uni to retake a year?

No. That cap is if you fail a module or year and have to retake it.
