a pigeon would not move and I'm scared of them. so did not want to get out. tried honking and moving slow but it would not move. it was a narrow road so I just waited for it to move .

but what if I didn't have time

Get out your car and walk aggressively towards it, without making any real contact. Then, if it still doesn't move, it deserves whatever happens to it afterwards

Normally my mother just drives straight through them. Luckily they clock that she's not going to stop at the last second and scoot off somewhere else.

Pigeons have very good eyesight and should see you coming. If they don't, well there are plenty more where it came from.

Just to answer the original question though, yes it is illegal to squish a pigeon if it doesn't move as you are intentionally killing a wild bird, and "being in a hurry" is not one of the things that would make it legal.
