why is it not illegal to push someone who is shielding the ball from going out?

Seen this wayyyy too many times, but the referee never blows and players never protest. When a defender is shielding the ball and letting the ball go out of play the attacking player who is trying to gain possession of the ball, seeing there is no chance as the ball is rolling out of the field, will just push the defender instead till he falls .

Surely thats an unsportsman-like behavior that warrants a yellow?
