Is it illegal for a minor to send nudes to an adult?

So say, completely hypothetically ofc, a minor under the age of 16 was engaging in a conversation with an adult, for example over 40. and both knew the conversation was of a sexual nature and were consenting to it.. would it be a crime if the minor sent nude photos to the adult? would they get in trouble or be registered as a sex offendor, even if the adult asked for the photo and sent one like that first ? or would it be considered grooming/sexual harassment?pls help obviously this is hypothetical haha the minor in question just may be worried they will be in big trouble.

I believe that if a child (under the age of 18) takes a sexually explicit image of themselves, they have committed an offence by making and possessing said image. If they have shared it, they have committed a further crime (distribution). The person who receives that will also be liable for possessing the image.

P.S. Your iteration of 'this is hypothetical' makes it seem not so hypothetical...

This is correct.

Even to your hypothesising that it isn't hypothetical...
Which one are you? The paedophile or the child? Yes, there's legal liability on both sides here, as has been pointed out above, but obviously the minor is being groomed which indicates greater legal liability for the 40 year old. I also don't think it would be in the public interest to prosecute the victim of a paedophile, but it would ultimately depend on what the CPS think.

Also, a sexual conversation between an adult and a known minor is illegal, and the adult would be facing jail time.

The child should tell their parents or a trusted adult, like a teacher, and get the police involved. They aren't anywhere near as mature as they like to think, getting involved in behaviour like this...

it’s embarassing for me to tell someone :[ the photos got deleted anyway so do u think i can still get in trouble if it got found out? even tho i trust the other person not to share it

i’m the minor but idk if it counts as grooming if you both gave consent :c i don’t think i’ll get in trouble cuz the photos are deleted but im still worried
The under 18 minor wouldn't get in trouble in this situation, it would be the over 18 adult. Even if pictures weren't sent originally and you guys were talking sexually (about sex??), the adult would get into trouble.

Cut contact with this person immediately. Do not speak sexually with any adult again. How lonh ago was this ?

1. The other person is over 18 and you are under 18 so it is illegal for the over 18 to have received these pictures, even if you willingly sent them.
2. Just because the photos are deleted doesn't mean they can't be recovered. This doesn't mean you will get into trouble anyway as the person is over 18 who you sent htem to.

You legally can't give consent because you're underage. I think you should report this creature to the police. Doubt you're the only child that he is exploiting.

You can't trust this person; they've shown that by committing criminal offences, and you don't know 100% the photos were deleted. You could get a warning or a record made for creation and distribution of child porn, even sending your own snaps.

Report him before he does it to someone else and it escalates.

like two days ago.. dont judge im mentally unwell i do things without thinking :{
but i looked back over the conversation and it was normal until the adult person made it sexual but i didn’t say no or anything

I'm not judging you. Yes it doesn't matter because they are an adult and you are under 18. The adult made it sexual. You need to cut contact with this person, not do this again, and talk to your parents / trusted adult about it

One thing to note is that the police will almost certainly refuse to take any action against a minor in the case of grooming by an adult.

Any adult knows better; please tell a trusted adult, be it your parents, someone at school or elsewhere.

You are in no way at fault; this adult took advantage of you.

the adult would get done for possing child porn or something like that even if he deleted them TBF he should have ended the conversation before it got to that point the mind would be see as the victim due to their age regardless of if they instigated it or not of course that is if they get found out.
