    is it legally possible to covert from a sole trader to a company ?

    would the case law on this issue be:

    salomon v a saloman 1897

    lee v lee 1961

    macaura v northern assurance 1925

    am i heading in the right direction ?

    Of course. 'Sole trader' is not a specific legal status, its just a description of what someone does. Sole traders can form a company just as anyone else can, obviously this necessitates meeting all the requirements for company formation.

    Yes, a sole trader can convert to a company. There are differences between a private limited company and a public limited company. I am assuming that you want to convert to a private limited company, in which case, your main statute is the Companies Act 2006. There are sections outlining the requirements.

    BTW Saloman v Saloman establishes that a company is a seperate legal entity. I believe, if my knowledge is not too hazy, that Saloman was a sole trader before it became a company. So that would be your case law.
