LearnDirect Issues

Has anyone had issues with LearnDirect?

I have signed up for an online course and opted for the instalments plan, they took the first payment earlier then I was told on the phone it will be taken and I never activated my account to access the course content as I didn't have time. I told the adviser I might not be able to have a look at the course materials till January.

However, I had to cancel the course due to some health issues and actually not having time to do the course, but as I cancelled outside the 14 days cooling-off period they are saying I am still liable for the full course cost, though I was only two days out.

Can anyone advise what they did to get out of it without legal action?

After endless emails to LearnDirect with no success, I asked for free legal advice from Queen Mary University and then wrote to Premium Credit and they said LearnDirect hasn't dealt with matters properly and agreed to cancel the course and refund me the first installment.

Hi I registered with learn direct on the 16th of April, the person who sold the course to me didn’t state premium credit would have to make the payment while I pay instalments every month, I was told to register the course with the sum of 9.99 and I told the personnel I wasn’t even sure I want to continue witty the course as I was having double thoughts and doubts, he told me I can go ahead that the certificate is recognised world wide and I can opt out if I want to, but I told him I can’t make payments immediately so he said I should pick 1st of May which I did, to cut the long story short, the personal who sold the course for me didn’t tell me the terms and conditions of Learn direct. I always go through my emails but though to the fact that I was very busy that period I didn’t check my email to see Premium credit sending me an email about 14 days cancelllation and all that, I saw the email on the 9th of may and I’ve been sending several emails to cancel the course due to the fact that I wasn’t stable mentally, I wasn’t feeling too strong and not financially stable to continue. Premium credit has cancelled on their part while learn direct hasn’t saying I have to pay the outstanding amount of the full course of which I haven’t activated the course or even started the course. Please I need help to go through this.

LearnDirect never provide or explain their T&Cs. I would write to Premium Credit again at [email protected] and they should be able to help.
I suggest you request to have a copy of the telephone conversation you had with the LearnDirect advisor first, then write to the above email address providing them with a copy.
Also, if you haven't activated the course on their platform, you do not owe them any monies as you haven't accepted their T&Cs.
I suggest you read the Consumer Credit Act 1974.

You can request a copy of the telephone conversation you had with the LearnDirect advisor. Their Data Protection officer will email it to you.
Once you have it, write to Premium Credit again at [email protected] and explain the situation.
If you haven't activated the course on their platform, you are not liable for any costs. LearnDirect never provide students with their T&Cs or direct anyone where they can be found and this is a breach.
I suggest you also read the Consumer Act 1974.

You are a consumer pursuant to the Consumer Rights Act 2015 (CRA) and are thus protected under this legislation and associated regulations. Technically, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (CCR) provides that with regard to the sale of digital content, “the cancellation period ends at the end of 14 days after the day on which the contract is entered into” (section 30(2)).
The CCR requires Learn Direct to advise you in full of your right to cancel pursuant to regulation 27 to 38 of the CCR (section 10 of the CCR, Schedule 2, (l), and Schedule 3). You were not given this information (including the cancellation form) when you agreed to sign up to the course. Instead, you were vaguely advised of the cooling-off period by the Representative over the phone and misled as to the point at which this period commenced. Because you were not given this information, you had 12 months (over and above the standard 14 day period) to cancel the contract in accordance with section 31(3) of the CCR (see below).
Cancellation period extended for breach of information requirement 31.—(1) This regulation applies if the trader does not provide the consumer with the information on the right to cancel required by paragraph (l) of Schedule 2, in accordance with Part 2. (2) If the trader provides the consumer with that information in the period of 12 months beginning with the first day of the 14 days mentioned in regulation 30(2) to (6), but otherwise in accordance with Part 2, the cancellation period ends at the end of 14 days after the consumer receives the information. (3) Otherwise, the cancellation period ends at the end of 12 months after the day on which it would have ended under regulation 30.

The LearnDirect officer is called Derek Clarke - [email protected]

You need to specify the date, time and name of the LearnDirect sales advisor that sold you the course. The person that sold you the course should have sent you an email confirming you have purchased the course. You also need to specify your LearnDirect account number - this was given to you via email.
Also, when you write to PremiumCredit, you need to use the reference number for the PremiumCredit account, which should have been sent to you via email.
It''s best if you call Queen Mary University and make an appointment first - you will find their number on their website.
However, when you have the appointment with them, they will ask you a lot of things so they can see if they can build up the case.
If you've already accessed the LearnDirect platform and went through some of the course, it will be a bit more difficult to cancel the course.
LearnDirect will always send UK Search to recover the full monies for their course. But they never make people aware or explain clearly where their T&Cs are or what the cancellation procedure is. And this is what you can use to get out of it.
You need the recording of the phone conversation you had with the LearnDirect advisor before you write to PremiumCredit.
There are certain steps you need to follow so you can get out of it.
You just need to know how to do that.
LearnDirect are a shady course provider and they will try everything to get their hands on any monies.
So, you have to do your reasearch and keep fighting them.

Thanks I contacted Queen Mary university and they said they’ll resume by September this year. And Hope this doesn’t affect my credit score. Because UK search is writing me frequently.

It shouldn't affect your credit score.
UK Search is a debt recovery company that LearnDirect employ, I am afraid.
Have you placed a complaint with LearnDirect and PremiumCredit?
If you tell UK Search you have placed a complaint to which you are waiting for a resolution, UK Search will confirm with LearnDirect and stop harassing you for about 30 days.

Yes I placed a complain to learn direct and no response, I later did with premium credit quality control and they replied saying they’ll carry out an investigation and if I’m not satisfied with the response I can then write to ombudsman to resolve the issue.

Hi could you give me more information on this. I signed up to a course two months ago and tried to get into contact with them ever since to cancel but they either never picked up or replied. I’ve had a death in my family and they genuinely don’t care and are charging me £900 for a course I haven’t even started and have no interest in doing. I’m genuinely stressed idk what to do

They are scammers, don’t give them any money, write to them and list reasons why you’re not owing them and stand on those reasons, in fact tell them to send you the voice messages you had with the personel who sold you the course. They’ll threaten you but don’t be scared. After I had much back and forth with them they actually wrote to tell me they’ve cancelled the course and I don’t have to pay out of their goodwill after I told them to send in the voice message I had with the personel who sold me the course.
