What do I need - I've a UK passport but live in EU

Hi

I have UK Citizen British passport, with a British mother, and was born and live in the EU. I fulfil the requirements for student loans, I think, but it's very confusing! Is there anyone else planning on starting uni in 2023-2024 who has advice on what exactly I need to successfully apply? I don't have an address in the UK, although lots of family there who could provide me with one. Do I need a National Insurance number?

When are you coming to the UK? Is your course starting September 2023? Can you confirm if you're applying for an undergraduate or postgraduate course? Can you confirm your nationality and where you have been living in the EU?

Hi there, thanks for your quick reply! I've applied for 2023 undergrad starting Sept. - one of my Uni choices has already given me an offer as a Home student based on the details I provided, not sure how or if that affects student loan though? I will need full tuition and maintainance as my parents are separated (not legally, but they have separate homes) and my mother can't afford to pay maintanance. I have a UK passport that states 'British Citizen', the Consulate here in Spain told us I would be counted as a 'returning citizen', even if I hadn't previously resided in UK. I have been living in Spain, born here with earlier years in Italy. My father is Italian, I also have an Italian passport which I guess isn't relevant in this case?

Can you confirm if you hold pre settled or settled status in the UK? When do you plan to come to the UK?

Hi there, this is Giorgio's Mum as he's at school!! Hello!! No, I don't think he holds either, unless this is conferred with a British passport, we were told by the British Consulate he was classed as a 'returning citizen' (what she called it). This is the problem, we've had different advice from several sources, including the universities themselves. He does have friends who went last year to Uni who got student loans so it is possible?!!

He plans to arrive in August/ Sept before term starts, all being well! We have looked at all the criteria and we think he fulfills everything for Home Status (From https://commonslibrary.parliament.uk/eligibility-for-home-fee-status-and-student-support-in-england/):

For courses starting between 1 August 2021 and 1 January 2028, UK nationals and their family members living in the EEA or Switzerland will generally be eligible for home fee status and tuition fee and maintenance loans if they meet the following conditions:

they have lived in the EEA, Switzerland, or the UK for at least the last three years;
they were living in the EEA or Switzerland on 31 December 2020;
they have lived continuously in the EEA, Switzerland, or the UK between 31 December 2020 and the start of their course.'

This applies to us so we should be eligible?? Re. the settled status - if you feel this is necessary, what do we have to do to get it?!!!

Yes, if he holds a UK passport he will be considered a UK national. If he was resident in the EU or EEA on 31st December 2020 or before, then he would be eligible for full support as a UK national.

Is this still the case as i have been told that my son is only entitled to the fees loan as he was born in Italy?

Hi Lisa. Our eligibility rules for EU students are the same as above for this current Academic Year so as long as your son meets the above criteria they should submit an application. Thanks, David
