does it have to be from your teacher or staff from sixth form, or can you get one from your employer? Applying on a gap year so just wondering if I need to email my old sixth form or not?

Unless you've been out of education for 5+ years universities will expect an academic reference. Your sixth form should be able to provide that easily.
