Migrant worker application cancelled

Hi,

I applied last year for student finance and was granted full support as a migrant worker. The conditions of the support was to remain in employment at a consistent level which I have.

My application now has been canceled. My tuition fees are cancelled and I’m 2 weeks away from finishing my 1st year of study. I’m so confused as they said I am a low level income and can’t determine if I qualify. I work 5 hours a week and make above minimum wage. I travel for uni and work. It takes me 3 hours round trip to my university campus and my lecture run from 9am -5pm. I go to university 3-4 times a week. I have done more hours in the past but they affected my attendance.

But the guidelines for the migrant workers don’t even disclose any information regarding minimum hours of work or minimum income. So how was I supposed to know this information. It is not stated on any government website or student finance forms.

I’m desperate I don’t know what to do not want to get kicked out of university. Please any advice?!

Hi Lori,

For Migrant Worker funding you have to be working at an acceptable level in the UK to support yourself financially. If you are only working 5 hours a week (20 on average a month) this would not be acceptable unfortunately. You may of been sent an EU application from the Migrant Worker department to apply for Tuition Fee only funding.

There's 2 options really, 1 would be to try and get more hours of work, the other would be to just apply for Tuition Fee support only on the EU application.

There isn’t any guidance for minimum hour or minimum income to qualify. how long will it take for my EU tuition fee only to be processed? So I am able to finish my 1st year at least.

Once we receive the application it can take between 4-6 weeks for processing, it would need to be sent by post.

Hello, What you do to students is unacceptable. Lori is right. But you Ross, you answer without taking into consideration what she tells you at all... There are no exact regulations for how many hours and how many hours even PER MONTH a student should work!!! Ross see Government regulations, see UKCISA before you advise students. You should have advised Lori to appeal the desicion instead of telling her to loose her home status and apply as EU student. There are assessors in this migrant’s workers team who unfortunately dont follow the Government and SLC regulations , but they act subjectively and in an arbitrary manner, doing whatever they want!!! This is not acceptable….! The indication in the regulations of SLC is that even a job with cash is permitted and the Assessor has to see at least 3 years of consistent working pattern. There is no information on how much the student should earn and how many hours should work!!! Your answer to Lori was unacceptable. These assessors in the migrant worker’s team as prejudiced towards students!!! They believe that students are weak and they don't have authority or connections to defend themselves Under the Government regulations- the UK LAW, the student has the wright if he stays even unemployed involuntarily from a job that would normally continue to work, to be considered as migrant worker and retain his status. Also to inform you Ross, if the student was seriously ill and he stopped working temporarily on the period of his illness, they can still retain their migrant working status. This is how you should inform here the students Ross. Because we are students and European ones it doesn’t mean we don't have rights, if an assessor makes unfair desicions. we have the right to challenge this with external parties from the Government and with even Members of Parliament involved, so the assessors should be fair to all and listen only to the Government regulations!!! The funding bodies - SFE, SFW are all under the umbrella of the Government and they should follow the Government regulations and do their job.

Hi, thank you so much for the support!! I feel actually seen! Unfortunately, the SLC doesn’t care, I have appealed the decision and they have stuck with their decision to cancel EVERYTHING! This is disgraceful and disgusting behaviour truly! The SLC doesn’t actually care about students especially migrant student.

I took what Lori said into consideration.

She confirmed she works on average 5 hours a week which would not be acceptable for Migrant Worker funding. If this is not an acceptable level of work then the Migrant Worker department have the right to remove the funding.
