EEA Migrant Worker Family Member

Hi, just a question. I am a family member of an EEA who has settled status in UK (spouse). I have Philippine passport but got pre-settled status. I want to ask if I'm eligible for maintenance loan. My husband is not working anymore from 2 years ago but I am working full time. I live in UK for 3 years already.

Thanks for taking time to read.

Hi there,

Can you please tell us what kind of course you're thinking of studying, and when it will begin?

Thanks, Graeme

Based on what you've said, yes - because you have Pre-Settled Status and plan to work during your studies you should be entitled to the Maintenance Loan.

To make sure we'd recommend making an application online as soon as you can and we can then confirm this.

Thanks, Graeme

So it doesn't matter if my eea husband doesn't work at the moment anymore as long as I still keep my employment during studies?

Hi there,

Can you confirm if you have limited leave to remain or have you been granted pre-settled status as an EU national?

Thanks, Drew

Hi Ruela,

If you are a Rest of the World National your status would be limited leave to remain or indefinite leave to remain. What status do you have as pre-settled would be if you are an EU national which you are not?

Thanks, Drew

Pre-settled status was given to me as I am a family member of an EU national. I have a share code.

You can get the settlement status in UK if you are a family member of an EEA or EU national

Hi Ruela,

If you have pre-settled status and are working then you can apply as a Migrant Worker. You will need to complete a paper PN1 form for the 2024/25 academic year and you can get the form from the Gov.UK website. It will then need to be posted to us and you will need to provide your Migrant Worker evidence.

Thanks, Drew

Thank you. May I know what evidence do you need? Do I have to send my payslips or just my Ninoy and share code?

Hi Ruela,

We will need a copy of your employment contract. This will need to contain your employment start date, contracted hours per week and it must be signed & dated by the employer or employee. We would ask for the last 3 months of your payslips and most recent P60 if available.

Thanks, Drew

When I did the Pn1, it's asking for my eea husband's employment and insurance number as I declare that I am his family member. However, he is no longer working. Will this be a problem? It's just Me who is employed now.

Hi Ruela,

If you have pre-settled status as an EU national then you will be the one who has to be working. It does not matter if your husband is working.

Thanks, Drew

Hi, thank you. I am working under agency. We don't have permanent contract. What do you think can I submit instead of Contract? I have p60 and weekly payslips showing I work 30-44 hours per week.

Hi Ruela,

If you do not have an employment contract we can accept an employement letter from your agency on their headed paper with the same details required on the employment contract.

Thanks, Drew

Hi, I have been granted pre-settled status as a Family member of an EU national. I'm not an EU myself. That's why I asked if you need my husband's employment or mine as I will be applying as a Family member of a migrant worker but apparently he stopped working now.
