Final Pay- Annual Leave

Hi all,

I have just recently left my job on the 3rd of May 2024. I had 21 days of annual leave left and I just got administered my final pay. I earned £96.15 per day. I received the correct amount of salary for the final week of notice that I completed, but I didn't receive a full 21 days worth of annual leave pay.. I am not sure why this could be? There are no contractual terms tied to this either. Our annual leave renews every 1st of April and we get a total of 25 days, I have only used 4 of those days before leaving.

Is there any other reason why an employer would not pay the full amount owed when annual leave is accrued? This was my first job so I am unaware of the process. I want to get some information before contacting the CEO of the company, who handles the payroll.

They would probably have pro-rata'd the days. You should have accumulated about 8 days of annual leave if the period reset on the first of jan. As you have taken four they should have paid you for four.

Oh 😭 I thought the days were already pro rata'd as we got 25 days as opposed to 28 days of A/L? It was just confusing for me how it was so low when I barely took any annual leave after it reset on April 1st.

You say your "annual leave renews every 1st of April" and that you "left [your] job on the 3rd of May 2024".

This means that you only worked one month in the current leave year -- which would entitle you to one-twelfth of your annual entitlement -- i.e. 2512{25\over12} days i.e. 21122{1\over12} days leave.

So if you took 4 days of leave in the time between 1st April and 3rd May, you've actually taken more leave than you were entitled to -- and your employer could choose to require you to reimburse the business for this.
