Separated and living separately

Hi, my partner is starting uni in September and is starting the finance process. We are married but separated, living in the same house but living separate lives, separate bedrooms, separate finances, etc. Will student finance treat my partner as a single person, or will my income be taken into account as well?

Will I need to provide any evidence or a letter to student finance to explain this situation or will everything be up to my ex-partner to prove?

Hi there. If you are married but separated then we would ask for evidence from him regarding this.

The standard evidence would be;

Council tax bill with 25% single person discount
Decree Nisi or a Conditional Order
Civil Partnership Conditional Order
Solicitors letter that confirms current marital status
A Signed Affidavit - a sworn declaration made in writing describing facts that they wish to state as true. Typically made under oath and signed then stamped by a Solicitor
Statutory declaration - Normally drafted by a Solicitor who is usually a Notary Public or drafted by a Legal Executive authorised to administer Oaths. Alternatively, the declaration can be made before a Magistrate (also known as a Justice of the Peace) or some Magistrates Clerks at a Magistrates Court

Tenancy agreement with 2 household bills in their name only.


I appreciate not all of these will apply since you are still living together. In these cases we would require a marital status declaration from (he would need to call to request this), and he would need to explain why he can't provide any evidence. A letter from yourself confirming the situation may also help. In these cases, we can't guarantee it will be accepted due to lack of evidence. Thanks, Leah.
