Tuition fees and maintenance loan

What support can a student get from SFE if he got his leave to remain after a 2 months of course start date? Will they only get tuition fees for all 3 years of degree or could get maintenance loan as well?

Hi Shan,

What nationality are they? Do they have Indefinite leave to remain as a rest of the world national or do they have Settled Status as an EU student?

Thanks, Drew

Hi Shanza,

It's to confirm their indefinite leave to remain wasn't awarded through the EU settlement scheme. Is that correct? Thanks, Jason

So the student must the residency criteria below to be eligible for the full funding

Have settled status in the UK (ILR, ILE, No Time Limit) or Settled Status awarded under the EU Settlement Scheme), this must have been granted before the first day of the first AY of their course.

Have been ordinarily resident in the UK and Islands for the three years prior to the first day of the first AY of their course, they need to provide Home Office status evidence for this period

Be ordinarily resident in England on the first day of the first AY of their course. Thanks, Jason

Hi Ross

They meet last 2 criteria but for the first one they received their ILR after a month or 2 of their course start date

Thanks

Hi Shan J,

In that case, the student would not be eligible if they gained Indefinite Leave to Remain as a Rest of the World national after the start of their course.

Thanks,
Calum

Hi Calum

But can they get their maintenance loan in 2nd year because by that time they will have ILR before starting the 2nd year?

Thanks

Shanza

Hi Shan J,

No, as a Rest of the World national they would need to have gained Indefinite Leave to Remain before the start of their course.

Thanks,
Calum

Hi

I have heard that there is been some changes in regulations and students
who were granted ILR after the commencement of their studies can be eligible to apply for the full package
of support from now on. Is that correct and where can I find that information please?

Thanks
Shanza

Hi Shan,

There are exceptions if gain a status in the UK after the start of the academic year. I have provided the list of those here for you-

You may be eligible after the start of the academic year, one of the following occurs:

Recognised as a refugee or granted HP or stateless person

Granted Migrant Worker status

The student’s state accedes to the EU

The student becomes the family member of an EU national

The student becomes the child of a Turkish worker/Swiss National/Swiss National in question (for child of Swiss National) moves to the UK

Student gains leave to remain status under section 67

Student is granted Calais Leave

Student is granted Indefinite Leave to Remain as a victim of domestic violence (DVILR)

Student is granted Indefinite Leave to Remain as a Bereaved Partner

Student is awarded settled status under the EUSS

Family members of Ukraine Scheme/ ARAP/ ACRS leave

Thanks, Clare

What if someone gets indefinite leave to remain as a family member of UK national after the month of their start date of the course will se still get maintenance loan?

Hi Shan J,

If you gain Indefinite Leave to Remain within the first academic year, you should be eligible however, it will be a pro-rata amount based on when you gained the status.

The best way to confirm your eligibility would be to apply and the pre assessment team will confirm this.

Thanks, Clare

Hi

One of my family members started their course in September 2022 and received ILR in mid October and now they are in 3rd year and did not get anything in all 3 years at all. They did speak to SFE about it and did whatever they were told to do so but at the end they got rejected for maintenance loan and any other support such as NHS learning fund. What could be the reason for that?

Thanks
