Hello,
I am a year 1 law student and still trying to figure out contract law, can someone please help advise me on how to go about answering the problem question below.
Many thanks in advance.
After a long and stressful period at work, Steve decides to take a short break. Enticed by an online advert he has seen, he decides to book a package holiday with Maria, a travel agent. The package includes five nights at a beautiful resort in Wales, three meals a day and a full programme of activities, including karaoke, to ensure that allguests have a great time. Unfortunately, Steve is bitterly disappointed when he arrives at the resort to find that there is only breakfast on offer and no entertainment. At the end of the five days, Steve complains to Maria. Maria says she is sorry and acknowledges all the shortcomings. But she says it's not her fault because the cook and the tourist entertainer had resigned only a few weeks before. She also says she can't refund Steve's money because he spent all five nights at the resort. To calm down, Steve decides to go for a walk. While walking near a cliff, he accidentally falls. He grabs a branch growing from the side of the cliff and calls for help. Another walker in the area, Albert, hears Steve's voice. He goes to Steve's aid and reassures him that he will be fine, but realising how difficult it might be to rescue Steve, he tells him that he will only rescue him if Steve agrees to pay him £100,000. Steve is initially outraged by this immoral demand and tells Albert to go away. Albert says "Well, as you wish" and slowly walks away. At this point, Steve reconsiders and accepts Albert's offer. When he is finally rescued by Albert, Steve changes his mind and tells Albert that he will not pay the £100,000. Albert insists that he wants to be paid what he is owed.
