Student Finance: Migrant worker

Hiya,
I am a student going to my second year of studies in September 2024.
I have been applying for tuition fee loan as an EU student with pre settled status. I will be continuously living in the UK for 3 year in September 2024.
I have now applied as migrant worker for the first time and awaiting a reply.
I have a few questions regarding that
1) how strictly do you have to have lived 3 years? I'm completing 3 years on 18th September 2024 but applied in July as I did not wanted to be very late in terms of loans and when university starts. Would 1 month away from completing 3 years of residency be enough for the whole application to be rejected? I have been waiting for about 4 weeks. If the application was to be rejected would it be already or it doesn't matter as I get a final answer in a few weeks?
2) I need to work certain hours per week which is understandable. What happens when you're sick a few weeks of the year (not continuously) or if you have booked 1 day off but not as annual leave? What happens if a week you don't complete the required 10hours and do 7 instead for such circumstances?
3) in case the application gets rejected, will it only be rejected in terms of maintenance loan or tuition fee as well? I'm normally eligible for tuition fee loan regardless. If so, do I need to apply again for tuition and how long would that take after getting a result of my application?
4) my payslips are monthly ones e.g. they show hours worked per month, how would I provide proof of hours worker per week? I am contracted but I would also pick extra shifts to make up the hours required to ensure that I am still considered as migrant workers.

Please bear in mind, I'm an EU student, lived almost three years in the UK and my whole live in EU country, work continuously and have pre settled status, also not married.

Would appreciate any answers either from Student Finance or previous applicants with their experiences, as it is quite a stressful time to be waiting about whether you are going to receive any help

Best regards xx

Hi username7199186,

It is very strict, if you are one month off the residency criteria then the application will be rejected. To apply as a Migrant Worker you need to have been ordinarily resident in the UK, Gibraltar, the EEA or Switzerland for at least 3 years prior to the start of their course.

If you are off sick you will need to send us evidence of this such as sick notes to retain Migrant Worker eligibility.

You will still be eligible for a tuition fee loan even if you are rejected for Migrant Worker funding. You will need to send us a paper EU application form and this will take around 6-8 weeks to process.

You just need to send us the payslips you have, these should show your hours.

Thanks,
Calum
