How much time it takes to get deposit fee refund from university of hertfordshire

I am international applicant from india and not able to pass sponsorship checks of university because of immigration history, when i send refund mail to university it said it will take around 40 days but my agent told me it will get around 4 months to get my refunds now i am a dilemma when i will get my refund as i have to apply in january intake next year but i will only be able to apply if i get refund fees.
