In what circumstances should abortion be permitted and why?

Norma Mccovery, infamously dubbed Jane Doe from the landmark judgement of Roe V. Wade stood before us all as a guiding angel, pioneer, and torch bearer for abortion rights and female reproductive rights only to have her long drawn and much needed fight reversed by the American judiciary in 2022. As clearly laid down by the court in this particular judgement that abortion was never an absolute right to begin with, it handed to women an unimaginable power that they had never previously had the opportunity to wield. For the purpose of this essay, abortion is defined as the right to terminate one’s pregnancy with reasonable restrictions during the gestational period. Therefore, it must be noted with caution that these reasonable restrictions are dynamic in nature as they span over a plethora of factors ranging from circumstantial to durational.

Firstly, I would like to put forth the grounds that permit for abortion using circumstance as a metric. Circumstantially speaking, abortion must be availed as a exception under instances of rape and financial issues. Discussing the rationale behind each of these circumstances objectively, let us take a look at rape. This essay defines rape as the unlawful act of having sexual intercourse with the victim against their will. Impregnation of a rape victim should guarantee abortion as it stems from an antecedent factor which is premised upon various human rights violations of the victim including their right to life, limb and body. It must be noted that merely punishing the offenders in this case is inadequate and this argument fosters a victim-centric approach. Furthermore, discussing abortion for women with financial issues is important and this measure should be coupled with awareness campaigns and sex education programs for women with reforms from the government’s end. However, this metric warrants a case of abortion in the status quo due to the prospects of not being able to give the child a secure future and entrapping the mother and child in a vicious cycle of poverty.

Secondly, the grounds of durational limits are of grave importance to prevent exploitation of the abortion rights. Aiding this claim, is the Medical Termination of Pregnancy Act, 2021 in India that imposes successive restrictions on the termination of the pregnancy depending upon the gestational period of the mother. Medical termination must be allowed with the consultation of one doctor up to 12 weeks of gestational period and with the expertise of 2 doctors up to 20 weeks of gestational period and an internal committee of able doctors established by the hospitals if it is between 20-24 weeks. It is imperative to note that the durational limits and the circumstantial limits are not exclusive of each other but rather overlapping and mutually applicable.

In conclusion, it suffice to say that the right to abortion although not absolute, must be granted to women with reasonable restrictions to help ensure a better and safer society for women. Furthermore, what must be recognised is that the awareness and educational programs among the poor and members from marginalised communities should serve as catalysts to bring about legislative reforms. Social agents at grassroots level such as NGOs and women-led mobilisations further need to take up the issue of reproductive and abortion rights for women to help provide a better community-centric approach. The burden lies upon the agents of social change to eliminate the stigma surrounding reproductive and abortion rights to ensure better discourse.
