I'm being failed over a resit I didn't apply for, What do I do? Uni of Leeds

In one of my pass for progress modules I applied for mitigating circumstances for an assignment in January, in order to resit it in August. In April I did a different assignment and handed it two days late but did NOT apply for mitigating circumstances on that assignment. Due to late penalties the assignment became a fail. A few days ago I found out that I had been put down to do a resit on the second assignment even though I did not apply for mitigating circumstances on that assignment. The rule at Leeds is that of you do mitigated resit you have to accept the new grade even if it is lower. So as I did not do the resit, it was marked as ABS and dragged down my overall grade to a 38.

How was I supposed to know that a mitigating circumstances form done in January would apply to an assignment in the next semester? I already am behind two years due to changing degrees and I was really looking forward to the second year modules so I am feeling really lost right now.

My tutor has also been fighting my case but with no luck. What do I do now? I have mental health issues (the reason for mitigating circumstances) and really worry how I will go on without the support I get at Uni.

TLDR: Mitigating circumstances applied to an assignment I didn't apply for. Without this I would have passed my module fine.

Are you sure it was mitigating factors that required you to resit. You said with late penalties you failed your first attempt, so you would have had to resit the assignment regardless of mitigating factors?

You can lodge a formal review and hope your case is considered, it’s sounds like your tutor is supportive however ultimately the university is not shifting position. You could also contact the student union for advice.

I think you are somewhat in a rock & a hard place, if you did not pass the credits in April then you can’t progress without them being awarded. Were you hoping to receive a condoned fail for your April credits, I struggle to understand what you thought would happen when you didn’t pass the second module.

Have you been offered an opportunity to resit the failed credits year? This might be your most realistic option if they are required for progression.

I had a meeting with my tutor and seems like there was a misunderstanding but it would be really hard to prove. If I do an appeal it may take several weeks and, even if its in my favour, I'll already be weeks behind everyone else. It may be best to just do the resit and then take the year to improve academically too. Do you happen to know any non-Uni mental health services in Leeds and the best places to look for full-time work? Thanks for your response!

Sounds like a positive step to focus on what is within your control, however I would encourage you to ensure the correct policies were applied.

I can’t help on Leeds mental health services, other than googling it, recommending you check what your university offers or say the NHS.
