My daughter holds a dependent skilled worker visa. She has lived in the UK since November 2020. Both parents are Nigerians awaiting their ILR. She has started an undergraduate degree course in September 2024. Is she eligible for student loan?

Hi Jason,
Her ILR is due in January. She holds a limited to remain dependent visa. My ILR hopefully comes out before the end of October. She has applied for student loan using her current visa.

Yes. We have been in the UK for more than 3 years and working at the moment.

As a Rest of the World national your daughter would need to have ILR in the UK before becoming eligible for funding.

What if both parents have their ILR? Will that cover for her?

It's possible that your daughter may be able to apply for the Tuition Fee Loan only if you have ILR.

You said your daughter's course began in September, is that right?

So does one or both of the students parents have Indefinite Leave to Remain? Before the moved to the UK in 2020 did they live in Nigeria?

Like I said earlier, the parents ILR is being awaited. They have applied awaiting response from home office. The student doesn't have ILR either. She's applying in January for her ILR. Both parents have been in the UK for up to 5 years. The student has been in the UK for up to 4 years. Her course has started in September.

Thank you for confirming. Based on what you have advised, the student should be eligible for the Tuition Fee Loan only as the family member of a settled person. If they gain the Indefinite Leave to Remain status in January, they can then send a SFE home student application (PN1) which includes the Maintenance Loan along with their biometric card and evidence of their in time application with the Home Office to show that their status has changed so that the entitlement can be pro rata assessed from the term they gain their status.
