Dependent Visa and Student Visa

Hi guys,
I have work visa dependent visa and have been in UK for last 3 years (2 June 2022) and visa ends on 1 November 2027 and I will be eligible for ILR on May 2027. I am from Pakistan and my dad is a Production Manger. Am I eligible for student loan? Thanks

So do you have limited leave to remain and how old are you? What is your dads status in the UK and does your mum also live in the UK? What is her status? Before moving to the UK did you live in Pakistan?

my Dad is on Skilled Worker Visa and yes mum lives with us and I am currently 17 and will be turning 18 next year in March. Before moving to UK I lived in Pakistan. I just looked at the Constituency casework Published Thursday, 04 April, 2024 which states “Previously, to be eligible for home student status in any academic year, some students had to be settled at the start of their course, but this is no longer the case for academic years starting on or after 1 August 2024.
With some exceptions, students must be ‘ordinarily resident’ in the UK on the first day of the first academic year of their course and for the three years before that date.” and also on SAAS which was last updated on 3rd Sep 2024 which states General residence conditions
In general, to be eligible to apply for support (tuition fees, student loan, bursary and living-costs grants), you must meet the following conditions:

ordinary resident in Scotland

ordinary resident in the UK and Islands throughout the 3 years immediately before the relevant date; and be one of the following:

settled in the UK within the meaning given by section 33(2A) (Interpretation) of the Immigration Act

a person (who has not applied for refugee status) but has been informed in writing by someone acting under the authority of the Secretary of State for the Home Department that is thought right to allow you to enter or remain in the UK and been granted leave to enter or remain accordingly which has not expired

the spouse, civil partner or child of a person described in the two previous bullet points”
Am I Eligible? So confused

No I applying through Student Loan Company but as the definition of ordinary has changed according to the Ordinary residence case law which was last modified on 12 August 2024 states “"It is my view that LEAs [Local Education Authorities], when considering an application for a mandatory award, must ask themselves the question: - has the applicant shown that he has habitually and normally resided in the United Kingdom from choice and for a settled purpose throughout the prescribed period, apart from temporary or occasional absences? If an LEA asks this, the correct, question, it is then for it, and it alone, to determine whether as a matter of fact the applicant has shown such residence. An authority is not required to determine his “real home” whatever that means: nor need any attempt be made to discover what his long-term future intention or expectations are. The relevant period is not the future but one which has largely (or wholly) elapsed, namely that between the date of the commencement of his proposed course”

Okay, thanks - last of all, do your or Dad expected to get Indefinite Leave to Remain / Settled Status in the near future? As in, within a year?

Okay, thanks - based on what you've said you're not eligible for student finance from us, unfortunately.

To be eligible you (or your family members) must have Indefinite Leave to Remain or Settled Status.

So, if either of you get Indefinite Leave to Remain or Settled Status you can be eligible then, but not until you get a status like this.
