SCENARIO
Kai McDaid recently inherited money from his grandmother and plans to start a business selling craft burgers. His first priority is to purchase a food truck, with a budget between £15,000 and £20,000. Kai wants to secure a vehicle by Friday, as he is leaving for a week-long holiday on Saturday.
On Monday, Kai contacts Victor’s Trucks, a trader and family business, selling a Citroen HY Catering Van online for £19,995, located in Newcastle Upon Tyne. Due to the long distance from his home in Bishop Stortford, Kai arranges a virtual viewing instead. The van appears to be in good condition and fully equipped for catering. Kai expresses interest but tells Victor, the owner of Victor’s Trucks, he will get back to him by the end of the week, as he is viewing other vehicles.
Later that same day, Kai contacts La Comida Specialista Ltd (La Comida), a company known for specialising in food trucks. Kai proposes to buy a new vintage-style truck with modern technical features, a year’s insurance, and a three-year warranty for £30,000. Concerned about losing this great opportunity but wanting to consider other options first, Kai pays a holding deposit to secure the truck, which will stop La Comida from selling it to another customer before Friday.
On Wednesday, Kai call Victor’s Trucks and leaves a message with Victor’s assistant saying he would buy Victor’s truck for £15,000. After that call, Kai speaks to his mother, who informs him that a colleague named Riona is selling a vehicle. Kai contacts Riona, who says he can have her old horse box that could be converted into a food trailer for £5,000. Considering the cost of converting it and purchasing a separate vehicle to tow the trailer, Kai says he will pay £3,500. Riona proposes a middle ground of £4,000. Kai says he will consider it and get back to her.
On Thursday, Victor from Victor’s Trucks calls Kai but speaks to his mother, as Kai is unavailable. Victor says he is willing to sell the truck for £15,000, but Kai’s mother forgets to pass the message along.
By Friday, without hearing back from Victor’s Trucks, Kai decides to proceed with La Comida. He calls to ask if he can pay in monthly instalments. La Comida says they can put a five-year payment plan in place, which would cost a total of £41,500 with interest and admin fees. Kai says he needs to check with his mother first and will call back but was unable to speak to her before close of business. The next day, Kai leaves for his holiday.
A week later, Kai follows up with La Comida and learns that the truck has been sold. His mother recalls Victor’s Trucks reaching out, but Kai has lost interest in that option and decides to focus on Riona's offer instead. He leaves her a voicemail, offering £4,000 for the horse box, but he receives no response.
Kai now seeks your help to explain the the negotiations and whether a valid contract has been formed with any of the parties.
