I am a Non eu Family member of Eu citizen

Hi i am a non eu family member of eu citizen who applied for student finance for tuition fees and maintenance loan , my age is 26 and i am living in Uk from 4 years and working as well from past 3 years and half, i was figuring out as i applied my own residence rights, they are saying we can't consider you migrant worker, but in Uk latest edition it is written if family members of Eu citizens have worked more than 3 years and 3 years residence in Uk they are eligible by their own mean.

Hi saadasif,

If you are not an EU or UK national, you must hold indefinite leave to remain to apply in your own right. There are exceptions to this such as being the family member of an EU national where you could potentially apply for the Tuition Fee Loan. If you are applying for support as a home student including the Maintenance Loan, it would need to be the EU family member who is working in the UK throughout your studies. As you are over the age of 21, you would also have to prove that you are either financially or physically dependent on the EU national family member to apply under that criteria.

Thanks, Clare

Hi saadasif,

You should provide a full cover letter and a letter from your father explaining how you are dependent on him to be reviewed. As advised, you don't meet the residency criteria to apply with your own residency status.

Thanks, Clare

Hi thankyou for replying a last question for my sister,
Can she be able to get student finance if her settled status will be in middle of her course, lets say she will start studying June 2025 intake, and she will get settled status in september 2025, So if she apply with pre settled status and then get settled status during her course , will she qualify for that
Thankyou in advance.

Hi there. Yes, she can. She would be eligible for funding in the term following her status being granted. Thanks, Leah.
