Student Finance Eligibilty with ILR

Hello, I am applying to university for the academic years 2025/26 after taking a gap year for this academic year. I took a gap year because I was not allowed access to student finance because of my immigration status. In August 2024 | was given permission to stay in the UK on a 5 year route to settlement. I had already deferred my place so I have decided to wait until 2025/26 to start University. I was wondering if l'm now eligible for Student Finance.

I'll give some context of my situation. I came to the UK legally when I was 8 years old. Because of some problems, mine and my family's visas were cancelled which led to us having to seek asylum. Now I am 18 years old so I have spent more than half of my life in the UK and all of my stay in the UK has been legal. Most places that I’ve researched says that u need to have lived 3 years in the UK as a ordinary resident, does this mean 3 years after being granted Indefinite leave to remain or does this mean just 3 years in the UK generally. Was I considered an ordinary resident while I was seeking asylum for all those years?

Hi Leah

My Nationality is Pakistani, and currently I’m pretty sure that I have indefinite leave to remain as I was granted permission to stay in the UK in August 2024 on 5 year route to settlement.
The 5 year route to settlement sounds like you have pre-settled status? Are you able to confirm this for certain as your answer depends on the advice we can give. Thanks, Leah.

Yes I can confirm I have pre settled status.
Thanks. If you are not a UK/EU national, you need to have settled status to be eligible.

There are some exception criteries to this rule. Such as being the family member of a UK/EU national, or long residency.

Since you arrived in the UK when your were 8 years old, have you ever left the UK? Thanks, Leah.

No I have not left the UK since I was 8 years old. I have spent more than half of my life in the UK as I’m 18 years old now.
If you are aged 18 years of age or above and have lived in the UK for at least half of your life or 20 years (whichever is the least) without a break in residency.

You will also need to:

be ordinarily resident in England on the first day of the first Academic Year of the course;

have been ordinarily and lawfully resident in the UK and Islands throughout the 3 year period preceding the first day of the first Academic Year of the course

*The three-year period prior to the first day of the first Academic Year of the course is included in either the total residency.

We would require evidence to show that you have been living in the UK for a period of time. For example if you were born on 06/05/2007 and your course starts on 01/09/2005, we would need evidence to cover from 03/07/2016. The evidnece must cover all dates from 03/07/2016 - 01/06/2025.

We can accept:

Employment type evidence that is in your name
P60
Wage slips
HMRC letters
Tax returns (Must be submitted)
Tax calculations
Wage slips

Bank statements that are in your name and show regular transactions
Original bank statements
Duplicate/ bank statements must be with a letter confirming they have issued you the duplicate statements or stamped by the bank
Internet printed bank statements must have the banks secure URL present and stamped by your bank

Benefit letters that are in your name
DWP letters, DLA letters, Jobcentre Centre Plus letters
Home Office documentation evidencing you have been living in the UK
Certified copies of documents
Child tax credits letter (In student name)
Child benefit

Medical Evidence
NHS letters detailing appointments and treatments
GP letters detailing appointments and treatments
Consultant letters detailing appointments and treatments
Appointment cards

If you were minor (under 20) during part of the residency period you may provide
Young person’s account
Child tax credits letter student as a minor
Child benefit letter student must be named
Letters from college or school must be dated/signed and state attended from and to dates
Original education certificates must be accredited by OFQUAL

During the time that I was awaiting a decision from the home office, is that considered as being an ordinary and lawful resident?

I’m not sure but i don’t think we had any status, as we were just waiting for a decision from the home office. I did some quick research and it says ‘pending’ status but I’m not sure if that is correct or not.
You would need to check this as you are required to have a valid and lawful status during these 3 years. Thanks, Leah.

I have checked this and as we were being provided aid by the home office while we were awaiting a decision, we had lawful status in the UK.

No, it was stateless status.

Alright thanks for your help, i guess I’ll find out if I’m REALLY eligible when I apply in march but from all the information given today I should be eligible.
