could i still get a 1st?

I am currently in my second year of uni and hope to end my final year with a 1st class.

However, the marks I have been getting are not hitting more than 70 :/

I recently flopped my property law assignment and averaged out to 58%. In another module, I got a 64% average. I still have four more modules this year, so is there any hope for me still reaching a first, or should I just give up lol

Yes, there's still hope. At most unis, third year is weighted more then second year, so if you manage to exceed 70% on average next year that should offset the modules where you got less than 70% this year.
For example, if your uni weights 2nd and 3rd year at 1/3 vs. 2/3 then every percent in third year is worth double that in second year. So a second year average of 60% and a third year average of 75% would yield 70% (a first) overall.
However, to take advantage of this you need to find some way of getting your marks up. And that's easier said than done!
