Withdrawal and Maintenance loan eligibility

Does someone know what withdraw from study really means ?
I had to change the University were I had been discriminated and after OIA ruled in my favour as it was already June I decided to transfer my credits to another University.
Now Student Finance is saying that because I withdrew I am no longer eligible to Maintenance Loan. This because this year I am 61 years old and it is a new course.
I retaireted that my course started when I was 58 and it is continuing but they are saying it is not a continuation because you withdrew.

I looked online and found that withdrawl is when a student leave his study and do not come back. Awful situation. I have been a victim of a discrimination because autistic and now I have to pay the consequences.

Hi there,

If you withdraw from a course and begin a new course then you would be assessed as a 'new student'. Students aged 60 or over on the first day of the academic year would be assessed for the special support loan. Thanks, Jason

Hi, it was not a new course it was a continuation as my credits from the previous year were transferred. In addition I did not withdraw I was had to change University after being a victim of discrimination and it was the end of the first year.

Hi there, you'd need to speak to the university to change your application from 'withdrawn' to 'suspended' if you hadn't originally withdrawn from the course. This would be required to update your account accordingly. Thanks, Jason

Jason, I tried but it is impossible for me to contact Birkbeck now. My emails bounce back. I sent all the emails as evidence to the stage two complaint showing that I was first suspended for 18 months then their decision was reversed after OIA outcome and they had to reinstate me although it was already June and I decided to transfer to another University. In their email their wrote that I withdrew.

Hi there, this would be a requirement for a reassessment to be done. We can't access accounts on this platform but if your previous application shows as 'withdrawn' then unless the university amends this your funding wouldn't be able to be changed. Thanks, Jason

Sorry but this is a mistake of the University. This cannot be put on my shoulder that I am disable.

Hi there, we would need them to correct this error to update this. You can always go down the appeal procedure: explaining what had happened for them to review this and determine if they still need the university to rectify this

Jason, I am already at the appeal procedure waiting for the case to be assigned to an external adjudicator. I will be helped soon by a PA social worker , do I have to ask her to contact Birkbeck on my behalf? I have already sent emails as evidence that I had informed them of my will to transfer to another University and I did also transferring 30 credits from the year I could not finish because the suspension

Sorry but instead of withdraw what should have they written? transfer ? because it was June and they asked me if I wanted to withdraw and I said yes meaning that I intended to transfer to another University but this was mentioned very clearly in all my emails and anyway it did not make sense to finish the academic year at Birkbeck as it was already June

Yes, they would state that it was a 'transfer' if you hadn't withdrawn but transferred to a new university/course. Thanks, Jason

Sorry Jeson a further question, do you think it is still possible to ask to amend this when I confirmed it was a withdraw? Note that I am autistic and I can prove that in that moment I was overwhelmed and taking medication. I was indeed confused and I egnored the meaning or the implications of using one word instead of another

We would need a correction from the university. So if the university does this (after your support worker contacts them) then a reassessment can still be done. Thanks, Jason

Excuse me Jason, what I don't understand is why is not enough for you that I sent you evidence of my intention to transfer. Why you don't consider the factually of the situation. You have also evidence that I transferred 30 credits.

How can you relay on information provided by a University who has already been recognized in fault by OIA Ombudsman? What if they refuse to do that ?
They have already caused me many troubles. They have been found guilty of discrimination. This is serious.
Why are you putting me in the incredibly difficult condition now having to contact them again (or someone for me) ?

Why don't you do this in light with the evidence I provided you ?

If a university have advised us you've withdrawn then we need them to correct their error. The eligibility rules for students 60 and over are regulations in place by the Department of Education to qualify for the funding. That's why this information is needed for a correction to be done. If you speak to your support worker and advise them of this. Thanks, Jason

could a reject to go back to the same University in June while perhaps that academic year had not ended yet be considered as a transfer or they would consider it a withdraw from their University, not a withdraw from my study
