I have a question that have been going in my head for a few days, it's legal to study the sqa answers from old past papers so if we getvask the same thing could just write the same thing from memory.

Yes, it is called studying and basically every single student does it.

So the sqa won't think is cheating as we are just memorizing their answers?

Yes, everyone does it. How else are you supposed to get the question right unless you know what the answer is?
