Absence from UK due to full-time education

Hello!
I have a question regarding the 3 year residency requirement prior to start of a PhD.

I am an EU citizen with settled status and have been living and (legally) working in the UK until August 2022. The reason for leaving was due to being offered a fully funded scholarship for 3 years, including a 2-year Master's programme in a non-EEA/EU country. I was in that country on a student visa, and I plan to return to the UK after completing my Master's to pursue a PhD. I do not currently have a permanent address in the UK.

I would like to know if I would be eligible for 'home' status and a loan, and if my absence would be considered as temporary.

Many thanks.

Hi there, in which country (or countries) where you studying in? Do you have evidence that this was of a temporary nature? Thanks, Stephen.

Hi Stephen,
I am studying in the Republic of Korea. I received an invitation letter from the Korean government that includes the dates of the scholarship (Sep 2022-August 2025) and details of what is funded (tuition, stipend, flights to and back from Korea after graduation). I'm expected to graduate in August and my student visa will expire within 14 days from that date, at which point I plan on returning to UK.

Thanks.

Hi there, from what you have advised, we would require for the application to be made for the PhD once available, and with this we would require all the evidence for the temporary break in residency to be sent to us to allow this for review.
Acceptable evidence can include:

A letter from a confirming gap year

A letter from a employer on headed paper confirming temporary employment including dates

A contract from a employer that clearly shows the employment is of a temporary nature

A letter from HM armed services/Commanding Officer etc

Temporary visas or work permits

Evidence to show that the student maintained a connection to the UK documents such as bank statements and utility bills can be reviewed

once we have been able to confirm that the break was of a temporary nature, this will allow for the application to progress. Thanks, Stephen.

Thank you very much for your reply.
Since I don't have a permanent address at the moment, would it be acceptable to use my family member's UK address for the purposes of the application? I will be staying there until finding my own housing after returning.

Hi yukicookie,

You would need to provide your own address so that we can confirm your address history. You can then update your address when this is available to you.

Thanks, Clare

Thanks Clare.
Do you mean that I should write my dormitory address in Korea even though it is temporary and not my permanent/home address?

Hi yukicookie,

No, you would put your home address.

Thanks, Clare

As I mentioned previously I do not currently have any address other than the dormitory in Korea. The house where I lived with my parents before undertaking the scholarship has been sold and my parents moved back to our home country. The only family I have in the UK is my aunt and uncle and I plan to live with them after completing my studies.

Hi yukicookie,

When you mentioned a UK family members address initially I understood that you did not live there, thank you for explaining that. If you normally live with your parents at that address, then you would put that address.

Thanks, Clare

I think this situation is a little complicated but I want to make sure I get it right so I will explain a little bit more. Thank you for your help, I really appreciate it!

1.

I moved to the UK when I was 9 with my parents, completed my undergraduate degree and worked for over two years whilst living with my parents.

2.

As soon as my contract expired, I came to Korea to study my Master's under a scholarship.

3.

Around 6 months after I left the UK, my parents sold the house and moved back to our home country - I don't live with them and haven't lived at that address in over 15 years.

4.

My only address at the moment is the dormitory in Korea.

If you could please help me figure this out I would be very grateful!

Hi yukicookie,

You would put your address in Korea in that case, you can also upload a cover letter to your account to explain your address history. If you have not lived in the UK or EU within the 3 years prior to the first day of the first academic year of the course, you would need to provide an explanation and evidence that shows your stay outside of the UK was temporary only. This is if you are applying now for support however, if you are in repayments, you would contact the repayment team for advice on the address.

Thanks, Clare
