I am Lena, an EU national with Pre-Settled status since 2020.
I have recently applied as a Migrant worker as I started work back in October 2024 for 15 hours a week. This is my last year, my course start date is September. I have become eligible this year and decided to apply.
My application was initially accepted then I received an email stating that I was rejected due to not being considered ordinarily resident in the UK on the first day of my course. My first year would have been 2020/2021, however due to being affected by Covid-19, I was unable to enter the UK until the start of November 2020. The course was provided as online study at the time. I am aware that the Department for Education made provisions for students applying that year to be considered as resident if they were in my situation, not being able to enter the UK due to travelling restrictions. It is also in the SFE guidance document called Assessing Eligibility for 2024/2025. I have been ordinarily resident ever since November 2020.
After several calls with SFE they say there is no such guidance, simply repeating that I am not eligible. I believe this is due to this being so much time ago but am really struggling as I cannot get my point across.
Any help or advice would be appreciated. Many thanks
