You don't have to specifically request it, but neither is it automatic: it's at the discretion not the Board of Examiners. But they'll automatically consider you for condonement, I'd that makes sense.

From Aston's General Regulations for Undergraduate & Integrated Master’s Programmes 2024-25 (with added emphasis by me):

"5.4 The Board of Examiners shall have the discretion to condone failure in a maximum of 40 credits in each academic Stage from Stage 1 to Stage F (i.e. excluding Stage P) provided that there is evidence of adequate performance from the student concerned. Period Examination Boards need to balance the possible effects of condonement on any assessments yet to be taken within that Stage and judge whether the student is able to demonstrate adequate performance from the modules assessed within the Stage at the time of the Board (see Regulation 1.9). The volume of condonement for an individual candidate should not exceed 60 credits in total across all academic stages of a Bachelor’s Degree and 80 credits in total across all academic stages of an integrated Master’s Degree.

5.5 Stage P may be condoned at the discretion of the Board of Examiners.

5.6 The threshold for condonement of modules shall be 5% below the pass mark. Marks below the threshold may not be condoned. The mark obtained by the student for each condoned module shall be used by the Board of Examiners in calculating the overall mark for the Stage of the programme and/or the student’s degree classification. The student’s transcript shall indicate that the module was passed by condonement."

OK. It was my understanding that Aston don't offer "with Foundation Year" variants of their undergraduate degrees. Instead they offer two one-year foundation programmes which can be a pathway to one of their undergraduate degrees:

Foundation Programme in Business and Social Science
Foundation Programme in Engineering and Applied Science

Are you studying one of these two foundation programmes?

Edited to add that although this page only lists the two foundation programmes above, this page lists a lot more. I've no idea why. Which foundation programme are you studying?

For reasons best known to themselves, Aston treat their foundation programmes / foundation years a little differently that I've seen done elsewhere. This becomes clear if we look at a change made a few years ago to their Credit & Qualifications Framework, and documented in New and Revised General Regulations 2022/23:

"CREDIT & QUALIFICATIONS FRAMEWORK

Minor amendment to Section 5.9, defining Levels of Credit, rebranding Foundation Year credit from Level 3 to Level FY credit. Aston no longer makes a defined award for the completion of Foundation Years, allowing Foundation Year credit to have the same status as Stage P, placement credit rather than Level 3 credit."

That being the case, my interpretation of the regulations would suggest that condonement does apply to the foundation year. This is based on the above stating "Foundation Year credit to have the same status as Stage P, placement credit" and the main regulations (quoted and linked to above) saying, "5.5 Stage P may be condoned at the discretion of the Board of Examiners."

However, their regulations are very unclear in this respect. I suggest that you speak to your Personal Tutor for clarity. Sorry. :frown:
