Paragraph 9B of the Student Support Regulations CLARIFICATION

What are the criteria for this rule?
Based on my understanding, the key requirements under Paragraph 9B of the Student Support Regulations are:

You were living in the EEA on 31 December 2020,

You have continued to live in the EEA for the three years leading up to the start of your course,

You are a family member of a UK national,

That UK national was also residing in the EEA during the relevant period.

I meet all of the criteria under Paragraph 9B as a non-UK national family member of a UK national:

✔️ I am the child of a UK national.
✔️ I was ordinarily resident in the EEA on 31 December 2020.
✔️ I have remained ordinarily resident in the EEA from that date until the start of my course.
✔️ My UK national parent was also residing in the EEA during this time.
✔️ I will be under 21 years old at the start of my course in September 2025.

Under Paragraph 9B, the residency requirement is that both the applicant and their UK national parent must have been ordinarily resident in the EEA, Switzerland, or Gibraltar for the three years immediately before the course begins. It does not require three years of residence in the UK. Therefore, the standard UK residency rule does not apply in this case.

Given that I meet all the above conditions outlined under Paragraph 9B, is there a specific reason for the refusal of my application?
