Postgrad loan eligibility - UK citizen living in EU since before Brexit

I´m a UK citizen and completed my undergraduate degree there before moving to Spain in September 2020 on a Temporary Residence Permit (5 year permit under the Brexit withdrawal agreement). I´m now applying for a postgraduate masters programme in the UK and will be moving back to the UK in September. I see that normally you have to be a resident of the UK for 3 consecutive years before being eligible for a postgraduate loan, however I see a clause that states:
"ou might also be eligible if you’re a UK national (or family member of a UK national) and you’ve been living in the UK, the EU, Gibraltar, Switzerland, Norway, Iceland or Liechtenstein for the past 3 years. To be eligible, you must have either:
1. returned to the UK on or after 1 January 2018 and by 31 December 2020 after living in the EU, Switzerland, Norway, Iceland or Liechtenstein
2. been living in the EU, Switzerland, Norway, Iceland or Liechtenstein on 31 December 2020"
For me, the 2nd option is true, I have been living in the EU since before 31 December 2020, and have remained there since, and I will be returning to live in the UK in September before my masters course starts. Would this mean that I am eligible for a student loan?
Thanks to anyone who has any insight or has perhaps done this themselves and can tell me how it was for them.

Hi Jason,
I came here to do a temporary teach abroad programme for 2 years, then stayed to work a bit longer. But my residency permit is a temporary 5 year residence. And I'm also under the impression that if I was here on 31st December 2020 then I'm covered under the Brexit withdrawal, as long as I return to live in the UK by the first day of my course starting, is that correct?

I don't have flight tickets as I came by car. But I have the 5 year residency permit and I still have a home address in the UK where I lived with family that my UK bank account etc is linked to

Hi Jason, I'd be returning in September and the masters starts on 22nd September. I'd be moving home to the UK permenantly so I'd have been in the EU for about 5 years temporarily

Hi Sarah,

A UK National does not need to meet the 3 year residency criteria as long as they have been living in the EEA for the last 3 years and they are ordinarily resident in the UK on the first day of the first term of their course.

However I believe I need to show that I was living in the EU on 31 December 2020 to be eligible, but I can´t see anywhere in the form where I can provide that information. I´m worried that if I don´t include that information, my application might be rejected. Although as I am UK national, I´m wondering whether that means I don´t have to provide the evidence. Could you advise?
