3 year living in UK rule

Hi,

I am a UK national and grew up in the UK and did my GCSEs and A-levels here.

After A-levels, I did a full time 3-year degree in an EU country and graduated last year. Then moved back to the UK for a few months.

At the start of this year, as I have an EU country nationality too (different from where I studied), I moved to work in that country for a temporary period and now plan to move back to the UK. However, to satisfy that country's requirements for health insurance, I had to complete a HMRC form (to get a statement of national insurance contributions) stating that, at the time of completing the form, I am a resident of that country.

I am now considering moving back to the UK and applying for a masters course at a UK university and masters loan. But I am concerned that living and working in the EU, albeit only for a few months, and particularly due to the previously mentioned form, means I may fall foul of the 3-year residency in the UK rule. Is this the case?

Hi, I have lived in the UK for my whole life until going to study in the Netherlands (bachelor's degree.) When I graduated last year I moved back to the UK. In January of this year I moved to the Czech Republic. I could return anytime between now and September, it also depends on your answer!

Hello, Would evidence of a UK bank account and being on the electoral roll throughout this period be sufficient evidence?

Also, I was just wondering if there’s a maximum amount of time below which it would be deemed as temporary? Because I’ve not been in the Czech Republic for very long.

Hi there, acceptable evidence would be one of the following if requested:

A letter from a university confirming a gap year

A letter from an employer on headed paper confirming temporary employment including dates

A contract from an employer that clearly shows the employment is of a temporary nature

A letter from HM armed services/Commanding Officer etc

Temporary visas or work permits

Evidence to show that you have maintained a connection to the UK (documents such as bank statements and utility bills can be provided)
