Theory of tort law is pretty likely to come up as its the only one that's never been in a question 9

its too short theres no way you can get 10 marks from it

Definitely possible, some of the areas are too short but some aren't like duty of care and vicarious liability. Plus they could easily do 2 different topics in the question, similar to how criminal theory is done.

These have already come up:
2020: fault - OLA57
2021: fault - private nuisance
2022: morality - OLA84
2023: fault - vicarious liability
2024: morality - psychiatric damage

i’m thinking 2025 may be morality with rylands v fletcher OR economic loss since that’s the 2 that haven’t come up yet for a question 9

on the aqa website tort content section, in the 'Liability in negligence for economic loss and psychiatric injury' part, it does not say duty of care, breach and damage. does this mean if we get a question on it we dont need to go through these steps first? i thought for all negligence claims we had to...

No you don't need to go through negligence elements for economic loss or psychiatric injury. For economic loss there will be a negligent statement so mentioning about the breach duty of care which makes the statement negligent very briefly will encompass this. There are no elements of negligence in psychiatric injury.
