How do you structure a discussion essay for Law @ Uni?

Hi all,

I have an exam coming up soon (24hr) in which we have one problem question & one essay based question. My course, to say the least, has been in shambles. Teachers leaving just before exams, new teachers who have never led classes before being thrown in and then leaving and being replaced, no one knowing where we've got to, and, worst of all, teachers providing ZERO guidance for the assessment... nevermind, I couldn't even ask my personal tutor because he isn't meant to be teaching the module!

So, I'm praying that someone here can provide me some guidance as to how I structure an essay based question, specifically for Contract Law. The question will be something along the lines of '[Person] said "....." Critically Discuss this statement in relation to [Key Contract Principle]'. The word count is around 1,500 and I would massively appreciate any guidance as to how I structure an essay in relation to this. I think one area I particularly struggle with is the discussion part, because quite often, the statements seem very one sided as in there feels little logic discussing the other side.

Hello @noodlestopshop_

I am sorry to hear about your experience. For problem questions you should structure your answer using the IRAC structure which stands for Issue, Rule (or Law), Application and Conclusion. You should do this for each legal issue. When it comes to essay questions, there is not really any structure but rather it is just your structure. You structure it as you like but it should always include an introduction setting out your argument and what you plan to discuss, the main body where you will answer the question with reference to relevant legislation and case law and critically evaluate this with your opinion and academic articles and then conclude by summarising your argument.

Although there is no structure per se, some suggest that you can use the IRAC structure for essay questions as well. If you want a more detailed explanation on how to approach such questions I highly recommend the following books-

Glanville Williams: Learning the Law

I hope this helps, if you have any further questions please do let me know.
