International or home student clarifyyy???????

SO, I am here in london as a dependant on my mother who's got a tier 2 visa. And like its a visa for 5 years after which when it expires we will just apply for an ILR.
I have heard that to be considered as a home student u need to have 3 years of residency in the UK. Is that true. Is it true that i dont need an ILR to be considered a home student.
Its only been 2 years of residency for me rn as of 2025 but if i take a gap year and apply next year will they consider me as a home student or not. Thats all i wanna know. Any help would be appreciated!! THANKSSS!!
