Am I eligible for a maintenance loan as the child of a pre settled migrant worker?

Hi everyone,

I’m currently applying for Student Finance and could use some help. At school, I was advised that I could only apply for a tuition fee loan because I have pre-settled status and was told I wouldn’t be eligible for a maintenance loan.

However, my mother also has pre-settled status and managed to apply for university a while ago. She received both tuition and maintenance loans under the migrant worker route, and she’s now finishing her final year of studies.

Here’s a bit more context:
Mother arrived in the UK in December 2020.
I arrived in August 2021.
We both hold pre-settled status.
My mother has been working in the UK.

Given that she’s been working and successfully received a maintenance loan herself, does that mean I could also qualify for a maintenance loan as her child under the migrant worker route? Moreover, what papers do I need to complete for this route? Do I need to change my application online?

I’d really appreciate any advice or if anyone’s been in a similar situation. I want to be sure before accepting just the tuition loan without exploring my options fully.

We’re both from Romania, and I am 19 years old. When I arrived in UK the school told me that I should repeat the year because it’s not okay to take GCSEs in the final year, so they placed me to start school in year 10, I hope that doesn’t affect anything.

Hi again, you may be able to apply under the Child of a Migrant Worker route if you meet the following criteria.
The student (and their family member) have been granted Pre Settled Status prior to the first day of the first academic year of their course.

We would require evidence of this (copy of Home Office award letter and share code).

Ordinarily resident in the UK, Gibraltar, the EEA or Switzerland for at least 3 years prior to the start of their course.

Ordinarily resident in England or Wales on the first day of the first academic year of their course.

The spouse/civil partner/parent/step parent/grandparent/child or grandchild must be working throughout the student’s studies.

The spouse/civil partner/parent/step parent/grandparent/grandchild must receive wages for this work.

This work must be effective, genuine and not of a scale which would be considered marginal or ancillary. (Must be enough to live on.)

So if I may be eligible then I need to fill out the PN1 form? Moreover, if I applied already only for the tuition loan then do I have to change the application from the website?

Hi there, yes, to apply for the Migrant Worker application you will need to make the application via the PN1 application form and post this to the address on the application form. If you have applied for tuition fees only (on the EU application form) then this will stay in place until the Migrant Worker application has been fully completed and then will be removed to allow the transfer to the Migrant Worker application.
