Denied Student Finance

I just found out yesterday that my application for tuition and maintenance loans has failed. The reason was failing residential requirements. I have home fee status but sfe does not think I am eligible for the loans.

I already went through this last year at Bristol, student finance informed me of their doubts about my residential status around late October.
Essentially it was many months of stress until I ultimately had to withdraw from school.
My professor/Head of Department stepped in, and sfe even spoke to him on FaceTime with all the details. Sfe actually encouraged me to withdraw and retry this year.

Though I narrowly missed it for my course start date last year, this year I definitely fit the requirement of being ordinarily resident for more than three years. I got unconditional offers from Bristol, Durham and UCL and was really hopeful.
Unfortunately, seeing other posts from people whose loans failed because of not meeting the residential requirement, my chances could be even slimmer.

I am a national, however I have almost no proof of connection to the UK before 2021 other than attending a school that taught IGCSE. I hold two passports, UK and Hong Kong.

I’m seeing these other students who have flight records and parents who manage properties in the UK, or have permanent employment contracts etc. and they are still struggling with the process.

My parents are both senior citizens and retired. Securing a permanent contract in the UK is basically reaching for the moon.
On top of that they are not fit to work. I have no other way of accessing university education. I just don’t understand why even encourage me to withdraw, wait and try again next year, only to give this exact same outcome.

The telephone advisor I spoke to on the SFE number was kind and spoke on my behalf to 2 separate senior advisors.
After an hour on the case, she told me that long story short, they suspect I’m only returning to the UK for education purposes and will not settle. The next step is try to appeal and prove my intention to settle with every little relevant evidence.

I have no idea how to prove this, as international students also open bank accounts, engage in community, and rent housing etc.

Seeing experiences of people who actually have substantial supporting evidence of connection to the UK before the 3-year threshold, I’m honestly really discouraged and feel so disappointed that there is no transparency, and the whole situation just drags out with uncertainty and false hope.

I actually looked into employment immediately after knowing my loan failed last year, thinking at least to make money before starting school again this year.
I fell sick with an autoimmune disorder under all the stress, that I ended up back in my UK hometown constantly visiting doctors.
I can’t even begin with how hopeless and disappointing this and entire situation is. There is no other way I can afford university education if this falls through. And then ‘try again’… fail again…then repeat.

Hi there, have you already submitted your appeal?
The evidence evidence suggests that this would be due to a break in your residency.
Acceptable evidence for this can be:

A letter from an employer on headed paper confirming temporary employment including dates

A contract from an employer that clearly shows the employment is of a temporary nature

A letter from HM armed services/Commanding Officer etc

Temporary visas or work permits

Evidence to show that the student maintained a connection to the UK, documents such as bank statements and utility bills can be reviewed in this case.

Hi-Get a first aid certification (normally around £150)Sign up for volunteering with St Johns Ambulance or basically anything community based. If they can see that you're engaging in community activities it'll be evidence that you can lean on.

The evidence needs to relate to the preceding 3 years, not going forward.

That is what I thought initially as well, until student finance England asked me for proof of connection to the before 2021 again- flight logs, family managed properties in the UK etc.

Lots of UK nationals who lived overseas and meet the three-year threshold have been requested evidence that have no relation to the preceding 3 years

I clarified my situation and student Finance confirmed that the issue was not concerning recent years, but me seeming to have no connection to the UK before 2021. Basically, I was told I need to prove I I’m not in the UK for the sole purpose of education.

Hi, that was what I was told as well- essentially the break in my UK residency is quite literally my entire life before 2021.
I was requested similar types of evidence for my first failed application;
after lots of back-and-forth this year Student Finance is well aware my parents are dual citizens and don’t need any visas or overseas contracts to work between both countries.
Essentially they have no work permits or employment contracts to show they were temporarily employed in HK, as they were ordinarily resident there.

Even worse is they have no UK bank statements or utility bills whatsoever before 2021…they left in the 90s. appreciate the help but I think my application is basically cooked, I’ve been looking into scholarships and hardship funds.

Hi there, I would advise to contact us directly so we can check the residency criteria that is being applied to your assessment, as there may be some actions or alternative evidence that may possibly apply. This would be worth checking as there are a lot of variables in relation to residency, and it would be best that we are not missing something in relation to your eligibility. Stephen.

I did try last year with confirmation of receipt and a decision from formal appeals in Darlington, the letter says if anything, my overall residential history suggests I’m ordinarily resident in Hong Kong as a family unit and not the UK, voluntarily established by my parents.
On top of that having no evidence other than Passports as a connection to the UK is a serious problem.

In my most recent interactions on the phone with student finance they suggested I gather evidence from recent years proving intention to remain and settle in the UK into the future.

My situation is tricky as we left due to the political situation and family problems, intending to settle in the UK, but don’t have official paperwork as asylum seekers because of being nationals and my mom’s need to visit family in HK.
I have a cousin who moved here around the same time on a long-term employment contract in the UK, however she was never our legal guardian and could not help, which was made clear by the senior advisors.

The strongest evidence they suggested I could bring in was a solicitors’ letter from England proving our intention to settle. Also some statements from friends and employers might help. However, even with that, they told me there was no guarantee of success.

If you've been denied the funding then an appeal would be the next step for this to be reviewed for you. Thanks, Jason

I recently received this letter on top of residential requirements; what does it even mean? I’m literally taking an undergraduate course at UCL. Looks more like a bureaucratic mistake as well. I’ve gone through this incredibly stressful process for many months now and I don’t understand why can’t SFE be transparent and straightforward instead of pulling all this.
