I’m Becca and I’ve started my first year studying law at the University of Edinburgh. December exams are rapidly approaching and I fear I’ve definitely not prepared nearly enough so this is hopefully give me motivation to get going! I had an S5 gyg last year which definitely held me accountable and I’m hoping to bring the same focus to my university studies.

If you’ve got any questions regarding the course, accommodation, or the applying to Edinburgh in general feel free to ask! I’d love to share what I’ve learned so far!

Outside of academics, I was a national level competitive swimmer but I recently injured my shoulder and was forced to stop. Luckily I was selected to be a coxswain with the university rowing team which keeps me busy and active!

Thank you very much! It definitely is such an interesting course and I love learning about the cases which influence our judicial system but I absolutely despise the exams lmao

What I Studied Today:
--> Contract Law
Topic(s): Formation of contracts
Time Spent: 3 hours
Productivity: 7/10
Notes: I got quite a lot done with contract but there's just so much. I'm through 2 of the large topic areas out of 15 (some of which are rather small). I'm at already 20 pages on my exam booklet so hopefully it will be really comprehensive and helpful when I go to sit it online.

Topic(s): Past paper patterns and Matrimonial Property
Time Spent: 2.5 hours
Productivity: 4/10
Notes: I've identified the key topics which regularly come up in exams and have started working my way through them. I've been putting this one off for a long time because it's my only in-person exam and I really don't want to do it haha.

Side note, I got my formative essay back and achieved 57% which was a bit of a shock to the system because I thought I had done quite well but it's okay! My tutor commented that I had used case authority very well and that my arguments were well written. However, she noted that I might benefit from looking more at legislative authority and the structure of my essay was a bit odd. I've emailed her for clarification regarding this last point and I hope she'll get back to me soon. It seems like a bit of a harsh mark considering her feedback was generally positive, but she did say her marking would be very harsh so that the exam seems easier.


Most Interesting Thing:
Using informal means of communications such as WhatsApp can still lead to contracts being created if essential terms are agreed. This is seen in the case of Jaevee Homes Ltd v Fincham (t/a Fincham Demolition) [2025] EWHC 942 (TCC)!

Thank you very much! My course is extremely interesting and I love (most) of what I'm learning. It's rather difficult but I'm beginning to find my feet and get locked in!

What I Studied Today:

Topic(s): Interpretation of contracts and Implied Terms
Time Spent: 3 hours
Productivity: 7/10
Notes: I’m beginning to realise that I might have underestimated just how much content is in these topics! If I go through 1/2 topics per day, then I have about two weeks before the exam to do past papers and understand what the markers really think. I’ve been make sure I have detailed notes regarding each case which is eating up quite a bit of my time, but past paper feedback shows that referencing niche cases in the problem solving section is always rewarded so I think it’s a good investment.

Topic(s): Past Paper Patterns and what makes a good essay
Time Spent: 2.5 hours
Productivity: 5/10
Notes: I've identified the key topics which regularly come up in exams and have started working my way through them. I really do dislike this part of the course because it’s just so boring and I feel like we keep repeating the same things over and over again. However, I think if I begin to prepare some essays than I might get more into it. While the questions are very, very specific, the same generic things come up over and over again. The feedback after exams always include what the top answers have so I’ve been looking at that to figure out what the essentials are.
The main topics which come up are usually: statutory interpretation, impact of mixed legal systems/why, EU principle of direct effect, Scottish Institutional Writers, and Judicial Precedent.

Most Interesting Thing:
There was a German Haakjöringsköd case, in which the parties erroneously thought that haakjöringsköd was the Norwegian word for whale meat, when it is, in fact, the Norwegian word for shark meat.

Cover Good Faith in Contract

Week: 1 (already late but it's fine) (24/11/2025-01/12/2025)

Hours Spent: 6 hours
How It Went: Pretty decent, it takes a lot longer than I thought it would and reading all the cases is so boring.
This Weeks Focus: Finishing all the notes

How It Went: I could've definitely been more productive but it was getting late. Maybe I need to work more on my study times. Still no notes back on my family formative.

Time Spent: 4 hours

Notes: It's much easier to study at the library, I just need to get there early enough to find a seat

Topic(s): Ius Gentium
Time Spent: 1 hour
Productivity: 2/10
Notes: I fear I missed out on quite a lot of important information while I was away on holiday last week. I should probably (definitely) catch up but the exam isn't for another 6 months so I definitely feel like I can take more time and ease myself into it more.

Side note, I got my civil formative back and scored 72%! My first ever first! I was super proud of all my hard work, especially because I found the essays really challenging to tackle. My main piece of feedback was to make sure everything was properly discussed and not just randomly dropped in. I was told that my "extensive engagement with scholarly literature [is] particularly impressive" and that I gave a "rich analysis". I'm really, really happy with how everything went.

There wasn't much criticism in it which I'm kind of disappointed about though. I feel like I definitely could've improved on some things and expanded more on smaller points.


Most Interesting Thing:
Children can use a Form F9 (Sheriff Court) or a Form 49.8A (Court of Session) to share their views with the court.

It's not strictly relevant to my academic studies at university but I attended my high schools academic awards night on Monday where I was presented with 4 subject awards (3 for being top of the year and 1 for being second), the Proxime Accessit award, Duke of Edinburgh silver, and an award for achieving 5 Highers! It was pretty cool to see all my friends and some of my old teachers. I've been invited back in December to say hi properly so I might do that

What I Studied Yesterday (26/11/2025):
--> Scottish Legal Systems
Topic(s): Statutory Interpretation + Lecture rewatches (from what I missed last week while on holiday)
Time Spent: 4 hours
Productivity: 6/10
Notes: I was definitely not locked in for the lecture rewatches because they were so boring and it was essentially a revision session for everything we'd done in the first 3 weeks of the semester. However, I really made an effort to think about statutory interpretation and think about potential essay questions/how I would tackle them. I finished a bunch of notes about different cases and when it would be relevant to bring them in.

Topic(s): Age of Legal Capacity, Section 11 Orders
Time Spent: 3 hours
Productivity: 7/10
Notes: I've looked through all the relevant cases for Part One of the exam which relates to the Child and it looks like I need to make flashcards for over 100 cases and legislation.

I also spoke again to my family tutor who marked my formative and she said that the marking was extra harsh because she doesn't have a background in academic writing and she's scared to give us really high marks for formatives in case it backfires for the final exam. She said that everything I had said was correct, well written, and exactly what she was looking for. She also said that had she just been marking without thinking about being harsh then she would have given it a mark of 65% (a solid 2:1) which I'm very happy with and also quite frustrated.


Most Interesting Thing:
In A v UK, a case where a 9 year old boy was beaten by his stepfather, the European Court of Human Rights said that his Article 3 Right to protection against torture and inhumane treatment had been violated and ruled that the UK had failed its obligation to protect him against such treatment. This reversed the decision of the English court that the punishment was okay under the defence of "reasonable chastisement".

Topic(s): Misrepresentation and Requirements of Writing
Time Spent: 3.5 hours
Productivity: 2/10
Notes: I, in fact, did not get locked in and I blame it on studying with my friend and being in our halls common room. I’m quite disappointed with myself because I promised that I would do a lot today because my friend is coming up for the weekend and I won’t get to study.

Most Interesting Thing:
Misrepresentation is a false statement of law which induces another person to enter into a contract. There are 3 types of misrepresentation: fraudulent, negligent, and innocent.
