I joined my father in the UK from a non-Eu country and got pre settled status in March 2022.
I applied for student finance as family member of an Eu citizen with presettled (the thread of questions in the pn1 form -particularly section 3 a4 and a6 - led to that. Later on, I panicked and reapplied as child of a migrant worker.
I got this response from slc
“Thanks for your application for student finance. You told us you’re the
child of a European Economic Area (EEA) National and are 21 or over.
You also applied for funding as a Migrant Worker but as you are not an
EU/EEA national, you are not eligible for this.
What you need to do
You need to send us evidence to show that you’re financially or physically
dependent on your parent(s) or step-parent.
Your parent(s) or step-parent’s original or certified copy Passport
or National ID card
• A copy of your birth certificate
If you’re applying through a step-parent you’ll also need to send their
marriage certificate and your birth parent’s ID.
The evidence you need to send to confirm why you are dependent is shown in
the below.
Financially dependent
- Bank statements showing your parent(s) or step-parent transferring money
to your account.
- Your parent(s) or step parent’s tenancy agreement if you are named on it,
or your tenancy agreement if your parent(s) or step-parent is named as a
guarantor.
- Any other evidence you think shows your dependence.”
My questions are as follows:
1) To get tuition and maintenance loan, what category should I have applied to?
2) can’t I just apply independently as the holder of presettled status? I submitted my share code in the application but no mention of that.
3) regarding sending evidence, does the financial dependency need to be continuous? What if all I have is regular bank transfers between my father and I from when I just relocated newly, and also letters from dwp, payslips, nhs, gp etc from 2022/2023?
4) if all fails, shouldn’t I be able to apply as a child of a migrant worker since my father works full time? Gov.uk doesn’t state anything about the child of a migrant worker holding an Eu passport themselves. Are slc wrong in this context?
