No it will not be child porn, if it was there would be a lot more kids in care after there parents were arrested for possessing baby pictures with their kids todgers in! Christ.

Even if it was, who the **** cares. You're taking a picture for yourself and only for yourself.
Don't think so. Though if you did send it to someone, I think you could get done for distributing child porn.

Actually, it is illegal. Nothing will come of it if you just store the photo, but send to a boyfriend or similar and you do face conviction for distribution of child pornograpy. Happened recently somewhere, I'll find the article.

Surely her being over 16 and over the legal age of consent makes this thread void anyway? Can't be child porn if she isn't a child.

The legal age for sexual consent is 16, if the other party is under 18. The legal age for pornography is 18. Pornography of under 18s is illegal, whether or not they're at the age of consent.

child porn is if the person is under 18.
I have complained on here before about the difference in age of consent laws and child porn laws. IMO, they should be the same age.

Child pornography laws apply up until the age of eighteen, actually.

I can't see it happening. Even if you're committing a crime, you'd never be prosecuted. I mean, I know when I was about 5 or 6 my mum took a naked photo of me. There was nothing wrong with it at all, we just live in such cynical times that people think about it with suspicion.

They still have to be over 18. It may seem ridiculous, but a 16 or 17 year old can have sex, but not appear naked in pornography.

I remember that. A girl send pictures of herself out on the Internet and got in trouble for sexual abuse of a child, producing child pornography, and distributing child pornography. But that was in America; I believe it's legal here to have pictures of yourself as long as you're over 16, and legal to have pictures of your boyfriend/girlfriend as long as they're over 16. But as far as I know, it becomes illegal if you break up.

I agree and disagree. 16 is the age for 'consent', so they make the choice to be involved in sex. If I were to be a 16 year old girl and opted not to have sex, whether I felt I was not ready, my body wasn't developed or I just didn't ever want it, then I would be pretty much clear. If anyone tries it on, I knock them back, if they go further it's rape. If I however take a picture of myself to see what I look like (@op) and then someone obtains that image, through whatever means, they're legally allowed to distribute it.

In an ideal world, yes, child porn and sex would be the same age, but that can't work.

It would only be 'child porn' if it was sexual. It isn't illegal to take naked pictures of children if they are completely non-sexual.

It is illegal to own porn of people under 18, but as long as you keep it to yourself I don't think there would be a problem.

Incorrect. It's pretty much a none issue with young children though. It doesn't need to be sexual.
