    It's not "equality under the law" because the law is making an arbitrary judgement on personal preference. In my opinion, if marriage was solely under the common law, gay marriage would have been legalised long before civil unions were created.

    Yes, it is "equality before the law". No matter which way homosexual marriage adovocates spin it, they will still need to redefine marriage to achieve their goals.
