Being blackmailed by ex.... watch

    What age are you? You have two options:
    1) If you are under 18, tell him he will be distributing child pornography and if found to do so you will contact the police. As you sent the photo, you would get into trouble with the law for distributing the image originally. To get around this, say that he sent the e-mail with the photo attachment from your computer to his e-mail address without your knowledge.
    2) If you are over 18 and there is no EXIF data on the photo, then tell him the photo was taken when you were under 18, and carry out the steps mentioned in 1).

    Pragmatically, it will be very very easy for him to forge an "email from you" in something he "forwards", so it's perhaps not worth getting too hung up about this side of things.

    But to my reading of the law, "do XYZ or I'll send around a naked picture of you" is clearly going to count as blackmail, though it's one of those things where a court would have to decide.

    Get legal advice.

    I'd say he's too stupid to know about the child pornography thing let alone know that you would get into trouble for sending it to begin with. Besides you could just say he accessed your files and sent it to himself.

    Just tell him that if he does send the photo that he'll be up for distributing and storing child pornography.

    I don't really understand the part where you've said he's making it seem like you've said stuff about you relationship but surely your friends would know what ever he is trying to get you to say isn't true?

    We've got mutual friends, and he is trying to persuade them that I am lying about it.

    Supposedly he wants them to know both sides of the story, but I have the suspicion he wants to edit my recount.

    If the distribution of the image is not illegal, especially if your 18+ and all he wants you to do is give an account of your relationship or whatever, how does that account to blackmail exactly?

    He has said I either give an account, or the email will be sent round to people.

    Do what you can to avoid him showing the email.

    But it really comes down to staying true to yourself.
    If you know and your friends know what really happened you'll be fine.

    If it makes you feel any better my ex's mother has seen a naked photo of me as well as his dorm mates. **** happens hey, its just a photo.

    It is against the law, but my problem lies in the email he sent me and various other people - some see it as blackmail, others as a reasonable thing.

    There's a key phrase in it: "I retained the email in case it was necessary to use it to reinforce my side of the story" (meaning, my explicit email). I think that very strongly indicates blackmail.

    He constantly kept hitting on me, and had started equally explicit conversations over MSN. It was tame comparing to what he sent me, and which I quickly deleted.

    Ok first mistake was going out with such a weasel.

    If he has convinced your 'friends' and they have believed him and they haven't even asked for your side of the story do they really sound like your friends?

    I'm sick of hearing about cowardly people using technology to get what they want and to make people feel like ****. There's been something like 4 teenage girls in the past year or so commit suicide in Australia because of what has been said about them over the internet. This is blackmail and cyber bullying.

    I'm not saying you're about to go end it all because some prick is being a **** to you but seriously this is one of those times where your going to have to face it if nothing can be done about it.

    If you have exhausted all avenues and he still pokes his little email out to your friends then its out there. But it's not the end of the world and its not going to ruin you, just keep your head held high and move on.
