The council of the EU and the European Parliament have adopted a Directive which makes a number of requirements concerning the teaching of EU languages in secondary schools.

The directive places obligation on Member States to make the leaning of atleast one additional EU language compulsory. Furthermore, funding is available by EU to fund additional resources. The directive requires each Member State to set up a body to oversee and administer the relevent funds. Due to be implemented 31st Dec 2011, however, the UK has yet to implement.

Highschool (X) already complied with compulsory language etc, however, unable to gain funds as UK has not set up any body to administer funds.

Chloe (Y) from a state-funded secondary school and Jasper (Z) from a privately-funded school; both wish to study an EU language, however neither school is giving them the option to do so.

*Understand that this includes emanation of state or state; Jasper cant rely on Direct effect only can potential indirect and Chloe can; and obviously highschool (X) will be pursuing actioin against UK so all well and good;

However, in respect of damages I am stuck; Highschool (X) will be claiming for any loss incurred for the extra teaching and learning etc due to the fact the UK failed to set up a body; what will Chloe be claiming for? will it be compensation? or just to force the school to allow an extra language to be taught? ; but how would this work if the UK still has not set up a body to administer funds?
