state crime prosecution?

why is it so hard to prosecute ? as its governed by the same body (the UN usually, right?) - its not the case of being illegal in one country and not in the other, or differing court systems.
also are there any cases which international laws differ between nations ? im not sure if dictatorships etc. contradict international laws ? sorry if i sound stupid - thank you !
