Misrepresentation regarding franchaising
Hey, just a quicky: if someone is coerced by another into buying their franchaise, mainly due to statements made by the seller, and those statements turn out to be largely untrue, is that misrepresentation?
Do the same tests apply that would come into the equasion when one is selling a tangible good? Any particularly relevant cases? Thanks

Two basic prerequisites. An unambiguous false statement of fact (or law) and reliance by the misrepresentee (i.e. the statement must induce you to enter into the contract).
What sort of things were said to you (i.e. is this material stuff or wrong colour or whatever) and to what extent did you rely on them when making your decision to enter into the contract?
