Identifying the relevant offence

Hi all,

I am working on a problem question where the scenario is given. We are asked to Discuss the defendants liability, if any, and address the relevant offences.

There is absolutely no mens rea for the offence. However, there is a classic actus reus for the offence.

Do you think that 'relevant offences' requires me to detail the AR of the offence to get marks?

In my eyes the offence is incomplete by the absence of any MR, so in my eyes there is no offence to detail.

Thoughts please?

thanks.
